Membership Agreement

TVT ELECTRIC ELECTRONICS COMPUTER CONSTRUCTION IMPORT EXPORT TOURISM TRADE AND IND.LTD.CO DISTANCE SALES AGREEMENT

This contract has been prepared based on the obligation to make a contract for sales made over the internet in accordance with the Regulation on the Application Procedures and Principles of Distance Contracts published in the Official Gazette dated 13.06.2003 and numbered 25137, and its articles are as follows.

ARTICLE 1 - SUBJECT

The subject of this contract covers the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers - Regulation on the Application Principles and Procedures of Distance Contracts, regarding the sale and delivery of the product, the characteristics and sales price of which are specified below, which the SELLER sells to the BUYER.

ARTICLE 2.1 - SELLER INFORMATION

ARTICLE 2.2 - BUYER INFORMATION

As a customer

ARTICLE 3 - PRODUCT INFORMATION SUBJECT TO THE CONTRACT

The type, quantity, brand/model, color, number, sales price, payment method of the Goods/Product/Service consist of the information at the time the order is finalized.

ARTICLE 4 - GENERAL PROVISIONS

4.1 - BUYER declares that he/she has read and is informed about the basic characteristics, sales price and payment method of the product or products that are the subject of the contract specified in Article 3 and all preliminary information regarding delivery and has given the necessary confirmation electronically.

4.2 - The product or products subject to the contract shall be delivered to the BUYER or the person/organization at the address indicated by the BUYER within the period specified in the preliminary information, depending on the distance of the BUYER's place of residence, provided that the legal 30-day period is not exceeded. This period may be extended for a maximum of 10 days, provided that the BUYER is notified in advance.

4.3 - If the product subject to the contract is to be delivered to a person/organization other than the BUYER, TVT Bilgisayar cannot be held responsible if the person/organization does not accept the delivery.

4.4 – TVT Bilgisayar is responsible for the delivery of the contracted product in a sound, complete manner, in accordance with the specifications specified in the order and with warranty documents and user manuals, if any.

4.5 - In order for the product subject to the contract to be delivered, the signed copy of this contract must be delivered to TVT Bilgisayar and the price must be paid using the payment method preferred by the BUYER. If the product price is not paid for any reason or is cancelled in the bank records, TVT Bilgisayar is deemed to be relieved of its obligation to deliver the product.

4.6- If the bank or financial institution does not pay the price of the product to TVT Bilgisayar due to the unfair or illegal use of the BUYER's credit card by unauthorized persons for reasons not caused by the BUYER's fault after the delivery of the product, the product must be sent to TVT Bilgisayar within 3 days, provided that it has been delivered to the BUYER. In this case, the shipping costs belong to the BUYER.

4.7- If TVT Bilgisayar cannot deliver the contracted product within the specified time due to force majeure or extraordinary circumstances such as adverse weather conditions or interruption of transportation, it is obliged to notify the BUYER. In this case, the BUYER may exercise one of the following rights: cancellation of the order, replacement of the contracted product with a similar one, if any, and/or postponement of the delivery period until the elimination of the impeding circumstances. In the event that the BUYER cancels the order, the amount paid shall be paid to the BUYER in cash and in a single transaction within 10 days.

4.8- Products that are defective or broken, whether sold with or without a warranty certificate, can be sent to the Importer company for the necessary repairs under warranty conditions. TVT Bilgisayar cannot be held responsible for any problems that may occur in the Authorized Service of the Importer Company.

4.9- This contract becomes valid after it is signed by the BUYER and delivered to TVT Bilgisayar by fax or mail.

ARTICLE 5 - RIGHT OF WITHDRAWAL

The BUYER has the right of withdrawal within (7) days from the delivery of the contractual product to him/her or to the person/organization at the address he/she has indicated. In order to use the right of withdrawal, it is required that TVT Bilgisayar be notified by fax, email or telephone within this period and that the product has not been used within the framework of the provisions of the relevant article. In case of use of this right, it is mandatory to return the cargo delivery report stating that the product delivered to the 3rd party or BUYER was sent to TVT Bilgisayar and the original invoice. The product price will be returned to the BUYER within 7 days following the receipt of these documents. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be returned. The cargo cost of the product returned due to the right of withdrawal will be covered by the BUYER.

The right of withdrawal cannot be exercised for products that cannot be returned due to their nature, single-use products, copyable software and programs, products that deteriorate quickly or have expired. The use of the right of withdrawal for all kinds of software and programs, DVDs, VCDs, CDs and cassettes, batteries, consumables (toner, cartridge, ribbon, etc.) is subject to the condition that the packaging of the product is unopened, undamaged and the product is unused.

In addition, the consumer cannot exercise his/her right of withdrawal for goods that are produced in accordance with the consumer's special requests and demands or that have been personalized by making changes or additions.

If the payment is made by credit card or a similar payment card, the consumer may request that the payment transaction be cancelled on the grounds that the card was used without his/her consent and in an unlawful manner. In this case, the institution that issued the card shall refund the payment amount to the consumer within 10 days from the notification of the objection.

In the implementation of this contract, Consumer Arbitration Committees and Consumer Courts at the location of TVT BİLGISAYAR are authorized up to the value declared by the Ministry of Industry and Trade.

If the order is finalized, the BUYER will be deemed to have accepted all the terms of this contract.
